We All Count: Counting the Days toward Equality

This blog is the fourth in a series from Rabbis Organizing Rabbis connecting the period of the Omer to the issue of race and class structural inequality.  Rabbis Organizing Rabbis is a joint project of the CCAR’s Peace & Justice Committee, the URJ’s Just Congregations, and the Religious Action Center. 

As we count the Omer this year in anticipation of receiving Torah, I am also counting the days in anticipation of a Supreme Court hearing on Marriage Equality to take place on April 28, 2015 and then sometime in June when the Supreme Court will likely rule on whether or not there is a right to marry in many of the states that have objected such as Alabama, Michigan, Tennessee and others.  As a long time Marriage Equality advocate I remember the happy summer of love in 2008 in California when I officiated at over 60 Jewish weddings between June 16, 2008 including the first legal wedding between plaintiffs in our California case, Robin Tyler and Diane Olsen.   But on November 4, 2008 it was over as a majority of Californians had gone to the polls to elect Barack Obama on the one hand but pass the notorious Proposition 8 which took away the equal right to marry from Californians.  As I stood on a stage in Hollywood that night at an election rally bubbling from Obama’s big California win, I had to comfort a community that had been sucker punched by an unholy alliance between the Catholic Bishops and Mormon Bishops in Utah and California.  More than 40 million dollars had been spent to demonize LGBTQ people and their families once again. It was the most expensive proposition race ever.

The next days and weeks were spent at rallies and protest marches.  I worked vigorously both in front and behind the scenes.  On the night after the election during a big rally in the city where I serve as rabbi, we began passing buckets to raise money to take this back to the courts. My congregation turned out in droves as did many in the Reform Jewish community who were stunned by the results.  I climbed on to the back of a truck that led the protesters through West Hollywood and back down Sunset Blvd. as my fellow activists and I took turns at the bullhorn.

The next night of protests one of the gay community leaders suggested a march on the Mormon Temple the next day.  I knew this would be bad from the start. As she led the marchers the next day down Santa Monica Blvd from West Hollywood to Los Angeles’ Mormon Temple you could feel the tension in the crowd and in the LAPD.  Traffic was completely snarled during rush hour-never a good thing in Los Angeles and those caught in the standstill were angry that they couldn’t get where they were going. That’s when scuffles began between drivers who got out of their cars and protesters.  More than one bloody fight took place. As the marchers turned toward the Mormon temple, my good friend and interfaith partner, Rev. Neil Thomas and I ended up guarding the Mormon Stake behind their Temple. The protesters were beginning to rush the doors.  It was Rev. Thomas and I that stood between the protesters and the Mormons. Luckily the protestors listened to us, kept to the sidewalk, remained calm and kept moving.

There are so many more stories to tell of that time.  But now this many years later I give thanks that marriage equality is legal in more than 33 states.  And so I am counting down the days-not only to receiving Torah at Sinai once again but toward Tuesday, April 28 when the case for marriage equality heads back to the Supreme Court.  Hopefully, it will be a positive resolution nationwide where marriage equality will be the law of the land everywhere.

The work of justice will not be done though. As long as you can still be fired for being married to someone of the same gender, as long as there are no protections in housing or education for LGBTQ individuals the work of equality and justice is not done.  And so I will still be counting in anticipation of that day and counting on all of you to help make that a reality.

Israel and LGBT Rights: A Work in Progress

Over the last number of years, Israel’s extraordinarily progressive positions on gays, lesbians, bisexuals and transgendered people has almost made up for the occupation of the West Bank.  I know that sounds ridiculous and, of course, it is.  But the reason I station them side by side is that as a progressive Zionist I have been embarrassed by the growing settlements in the West Bank.  And as a progressive Zionist I have enjoyed overwhelming pride from Israel’s remarkably forward support of gays and lesbians.  The GLBT community is safe and thriving in the heart of the Middle East—Israel—while every surrounding country is hostile and dangerous for our community.

By way of full disclosure, I’m a lesbian rabbi.

So when Education Minister Shai Piron, the number two in Yair Lapid’s Yesh Atid party, spoke recently against the legitimacy of gay and lesbian couples, my heart went out to Israeli gays and lesbians, especially to the youth.  And I would have been embarrassed, except for that I’m buoyed by the rigorous debate in Israel that followed.

Piron’s remarks were, “I think it’s a Jewish State’s right, maybe even its duty, to say to same-sex couples who decide to live their lives together: this is not a family.”

Once I learned that he had offered an apology, I sought to write a piece on the power of remorse and t’shuvah (repentance).  Unfortunately, if you look at Piron’s apology, he does not in any way retract his remarks.  On the contrary, he makes the point that, “it’s not up to me to decide what a family is and what it is not.”  In other  words, he admits that if it were up to him, families like mine would not be considered a family.  All he is conceding is that he doesn’t have the ability or right to make that decision for us.

This should come as no big shock considering that, according to “The Times of Israel,” Piron, an Orthodox Rabbi who was the head of a religious-Zionist yeshiva, said before he joined Yesh Atid that “homosexuality could be fixed.”  Piron and Lapid later stated, when Piron entered public service, that Piron had, “changed his views.”

So then what do we make of the fact that openly gay TV host Asi Azzar expressed support  for Piron despite his comments because his actions in the Knesset, according to Azzar, have been helpful to the gay community?

This reminds me a bit of how we feminists looked the other way at Bill Clinton’s sexual harassment of women because he took such pro-female positions when it came to the law and his bully pulpit.

Piron is not where he should be on the issue of gays and lesbians.  We err if we make allowances for his homophobia just because he is less hostile than other Orthodox Rabbis.  And we make a mistake when we forgive someone simply because they are not as homophobic as they once were.  As an American resident it is not my place to call for the resignation of an MK.  But I think that it is imperative to keep criticism of his position highlighted so as not to make room for a homophobic point of view just because we are grateful for the dialogue.  And if I lived in Israel, I would be protesting his leadership as Education Minister as much as I would protest West Bank settlements.  They are bad for Israel and bad for the Jews.

My parents are Sabras who met while serving in Tzahal and moved to the US in the late 1950’s.  When they became American citizens they had to swear that they were not homosexuals.  We have come a long way in the United States and any gay activist knows that individuals often come along slowly on this issue, while others awaken suddenly.

Okay Shai Piron, kudos to you for not being as anti-gay as you used to be.  And thank you for wishing that you hadn’t hurt people’s feelings.  And I am glad that you sometimes vote correctly on LGBT rights.  But you are not where you should be.  You are a work in progress.  If you can find access to a fast-forward button that gives you the wisdom and courage to be diametrically opposed to the position of most Orthodox leaders, I will be very proud of you.

Marriage Equality: The Long Parade of Our History

Last night, I went to see a high school production of The Laramie Project—the play that portrays the people of Laramie, Wyoming in the wake of the murder of Matthew Shephard, a gay college student.  A class of high school juniors and seniors at an exclusive, private school here in Chicago put on the production.  I went to support one of our synagogue’s high school students who played a few roles in the play. Fighting tears through much of the second act, I was heartened by the portrayal of brave priest who organized vigils and preached compassion and healing.

I find myself increasingly using every opportunity I have to carefully teach Biblical texts that have been used to perpetuate a close-mindedness that has too often led to violence and oppression of the spirit.  Midrashim (ancient and modern) abound illustrating creative and compassionate ways to interpret our Torah, while giving kavod to the text.   Owing much to brilliant colleagues and other thinkers including Judith Plaskow, Rachel Adler and her son Rabbi Amitai Adler—to name a very few—I have found new ways to understand ancient texts, adding new blessings and rituals to fit current situations.

I love bringing these values home to my two sons Eli (6) and Ben (4).  In the fall, I took Eli and Ben to Springfield, Illinois for a rally and lobby day on Marriage Equality.  My sons already had experience with the Pride Parade literally strolling aside Temple Sholom’s float.  I thought this would be another fun, memorable, and meaningful experience—especially when we found out that my parents would meet us there.  The only problem… I didn’t read the weather report.  In Springfield, we stood outside in a downpour, barely shielded by the boys’ kid-size umbrellas.  Finally, we found some space underneath an overhang near the steps of the capitol building.  By this point, our oldest son was crying—loudly—“I want to go home!”  I bent down so that we could make eye-contact.  I said, “Look around.  Many of the people who are here did not have such an easy time growing up, falling in love and marrying the person whom they love.  When they see you, they have hope that the future might be different for your generation.”  Eli, who is an old soul, met my eyes and said, “I know, mommy.  I know.  But this is NOT FUN!”

So, the day was memorable and meaningful, but as Eli said, not fun.  Yet, it made an impact.  The next day, Eli shared his experience with classmates during circle time at Chicago Jewish Day School.  Ben, along with his friend who has two daddies, has become known in his Gan Shalom classroom as an “expert” on Marriage Equality.  When we heard the news that Marriage Equality passed the House in Illinois, we sat in the boys’ bedroom making celebratory phone calls to my parents and my grandmother.  It felt like we all could share some small part in this collective victory.  After the phone calls, when my husband arrived home, we all sang the Shehechiyanu thanking God for bringing us to this sacred time.

Toward the end of the Laramie Project, a character shares how moved he was during the first Homecoming Parade following Matthew Shephard’s attack.  He said:

As the parade came down the street … the number of people walking

for Matthew Shepard had grown 5 times. There were at least 500 people

marching for Matthew. 500 people. Can you imagine? The tag at the end

was larger than the entire parade. And people kept joining in.

I feel like I am joining in this long parade of our history—following those who have attempted to bring more compassion into this world.  For this, I am grateful.

In Response to Kansas Bill HB2453

This speech was delivered at the Equality Kansas Rally on February 25, 2014, in opposition to Kansas Bill HB2453, which explicitly protects religious individuals, groups, and businesses that refuse services to same-sex couples.

Look around you! Look where you are standing! You are standing at the State Capitol in Topeka, Kansas. In less than 3 months, on May 17th, it will be exactly 60 years since the Supreme Court of the United States decided that school segregation is illegal and against the Constitution of the United States. 

My God, people: have our legislators learned nothing?  How long will God tolerate our stubborn insistence rebelling against God’s word: Human beings are created, every one of us, in God’s own image?

I am Mark Levin. I am a Jew; I am a rabbi; and I am a founder of the Mainstream Coalition.

I am here today as an American, the land of the free and the home of the brave.  I know what preserves our freedom. It’s the rule of law.

I remember segregated schools. I attended racially segregated schools. How dare people in Topeka, Kansas, 60 years after Brown vs. the Board of Education, argue that religious exclusionists have a right to exclude citizens from equality? Many churches argued that blacks were inferior human beings, and did not have the right to be educated with whites, as the local Westboro Baptist Church argues that God hates gays today.  Really!  Our legislature wants to side with the Westboro Church? 

What protected those African American families, the 13 families and 20 children who sued the Board of Education for equal rights under the law? What integrated our schools and brought African Americans and whites together: equality under the law!

“NO JEWS OR DOGS ALLOWED.” That sign kept my father out of the public swimming pool where I as a child swam 30 years later. My father was routinely called a Christ-killer; only one anonymous phone-caller ever dared call me “a damn Jew.” Between dad’s childhood and mine came the Nazi murder of millions of Jews, gays, lesbians, and Roma. American soldiers fought the Nazis. The Nazis murdered Jews. Therefore suddenly in the public mind Jew-hater meant Nazi. Auschwitz killed the Nazi brand because it taught where hatred leads.

In my father’s childhood, businesses discriminated by religious belief. In Johnson County the City of Leawood excluded Jewish and African American home ownership. Blacks could not swim in my childhood pool in Baltimore because they were considered inferior to whites. All this murder and hatred was religiously justified.

Fashions change. Hatred remains. The Nazis made hating Jews unfashionable, at least overtly in polite society. But the law forbids Americans to turn their religious hatred into refusal to do business. Society demands that if you are open for business to anyone you are open for business to everyone.

The Civil Rights Act of 1964 legally ended discrimination in public accommodations against racial, ethnic, national and religious minorities, and women. Restaurants had to serve blacks, no matter how much a religion justified hatred. But now, some Kansans again seek to get the law to permit their religious hatred of other Americans. We’ve walked this path before.  Have we learned nothing from hatred and bigotry?

Christians and Jews both believe in a God of love. Genesis teaches that all humans are created in God’s own image. For those who believe that there is to be divine punishment of actions you consider to be a sin, then let God take care of it. God commands God’s people to love the image of God: every human being

We do hold something sacred as a nation and a people: it’s called the Declaration of Independence of the United States of American:  We hold these truths to be self evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the Pursuit of Happiness.

We are the mainstream in Kansas.  We are the truly religious, who value God’s creation.  Let segregation, bigotry, and hatred cease. Let us rise to the love that God commands for all of God’s creatures.

An Historic Day for Equality

Today is a true historic day! A moment when you can feel the chains of bondage breaking. The Supreme Court has ruled that DOMA, the Defense of Marriage Act, is dead. The Gay and Lesbian married couples cannot be denied federal rights and benefits. And Proposition 8, the hateful ballot proposition in California that went into affect in November 2008 taking away the right to marry is also history. The court ruled that the people who sponsored Prop 8 who took the case to court when the State of California Governor and Attorney General refused to sponsor the court case, had no standing to do so. Thus Prop 8 which was declared void and unconstitutional by a lower court ruling is just that unconstitutional.

While the Supreme Court avoided ruling on a sweeping marriage equality platform across the United States, the ruling means that now in 13 states (including CA) and the District of Columbia where marriage is legal, the Feds must recognize that marriage in the over 1138 rights and benefits and privileges at the Federal level.

The marriage equality fight isn’t over in the United States. There are many places where gay men and lesbians cannot legally wed. And there are 33 states in the US where you can still be fired for being gay! That is why it is time for the Employment Non-Discrimination Act to pass the House and Senate. The marriage equality and adoption rights must still be fought state by state.

We aren’t full citizens yet. But today for sure… a little more.

I am grateful to God for this day. A day of blessing for sure. A day where we feel God’s justice showering down upon us and encouraging each of to continue the work of Tikkun Olam-repairing a broken world.

What Matters to Us: Reflections from the Consultation on Conscience

The disconnect is striking.

“The Jewish vote,” we were told last year, is all about support for Israel.

But here I am at the Consultation on Conscience.  Israel is on the agenda, to be sure.   But it’s a crowded agenda.  And our friends in Washington seem to “get” that better than the pre-election press.

4347252961_4923cd8cd0_oThe Consultation’s keynote was a conversation between Rabbi Rick Jacobs and Ambassador Susan Rice.  They talked about Israel.  But they also struggled with Sudan and Syria.  They emphasized international LGBT human rights.

Senators and members of Congress of both parties are poised to talk with us Tuesday about immigration reform and economic fairness, the environment and international human rights.  And about Israel.

Danny Gordis claims that too few of us prioritize our own people.  He argues that our universalism, unique in Jewish history, harms our own people.  But the argument between universalism and particularism goes back to the Bible itself.  Ruth suggests that redemption can come from anywhere, even Moab. Ezra takes the opposite view. The best of our prophetic books, Isaiah, cries out for justice, seamlessly, for Israelite and foreigner alike.

So what energizes the crowd at the Consultation?

Judging by the applause, marriage equality is a critical concern, along with its near relative, LGBT employment non-discrimination.  For me, that’s personal:  my mom is a lesbian.  As a congregational rabbi, LGBT equality is a concern in our own Texas community, where our members can and do lose jobs because they are LGBT. But admittedly, these issues are universal.  My read of the prophets tells me to join Rabbi Jacobs and Ambassador Rice, concerned about persecution for LGBT folks worldwide, in countries with no Jews.

Immigration reform is high on our agenda, particularly for the rabbis at the Consultation who are leading Rabbis Organizing Rabbis.  Some of our Jewish communities include immigrants whose status would be affected, but most are outside the Jewish community.  So perhaps we should be surprised that the polling data before us shows that American Jews photo-16overwhelmingly agree that a path to citizenship must be included in comprehensive immigration reform.  For me, and I’m not alone, this view is motivated by Torah:  We are commanded to remember the stranger, for we were strangers in Egypt.  And my views on immigration are motivated by the American Jewish experience:  We Jews, better than some other Americans, recall our people’s immigrant experience and identify immigrants’ journeys with those of our own forbears.

But make no mistake:  Israel’s peace and security remains very much on the minds of Consultation attendees and our speakers.  We lauded Ambassador Rice on the partnership she and the administration have shared with Israel at the UN, facing adversity together, and she told us about Israeli strides at the UN that were news to many of us.

All of the above are concerns at the Consultation.  All are Jewish social justice priorities.  All are universally important, and all are particularly Jewish.

A Real Passover Journey: The Road to Marriage Equality

I just returned from three days in Washington, D.C. to celebrate the beginning of Passover and an important crossroads on the road to freedom for the LGBT community.  The first two days of Passover were momentous because this year’s story outlined in the Haggadah was more personal than ever before.   The Haggadah reminds us to imagine that we went forth out of Egypt ourselves. As I stood on the steps of the Supreme Court on Tuesday and Wednesday mornings, the first two mornings of Passover, surrounded many dressed in red  worn for LGBT equality, I knew I was marching out of Egypt.

This year the Supreme Court of the United States heard two important cases about the freedom to marry for gay men and lesbians in our country. On the first morning of Passover, California’s Prop 8 case was heard. This case concerns whether or not Proposition 8 that was passed in November 2008 is legal. In other words, can a majority of voters take away rights from a minority!  Marriage equality was legal in California from June 2008 until the proposition passed in November 2008.  More than 18,000 couples married during that time.  I had the privilege of performing the first marriage in Los Angeles County.

On Wednesday the Court heard Windsor v the United States.  Edie Windsor sued the US for not recognizing her marriage to Thea Speyer. Upon Thea’s death Edie had to pay $363,000 of federal estate tax because the Defense of Marriage Act or DOMA would not recognize her as the legal spouse. Edie knew this was an injustice and wanted to do something about it. She and her partner of over 40 years were married in Canada but the federal government did not recognize their marriage when Thea died.

Our Reform movement has long been an advocate for equal rights for the LGBT community.  The first resolution of support came in 1964 by the then National Federation of Sisterhoods now Women of Reform Judaism, who called for the decriminalization of consensual sexual relations between adults!  In 1984 our then UAHC in a biennial resolution called for federal recognition of domestic partnerships for gay and lesbian couples and equal federal benefits to marriage! And our own CCAR endorsed civil marriage for gay men and lesbians early on in the marriage equality movement in 1996!

But on Tuesday morning as I prepared to speak at the rally on the day the California Prop 8 case was being heard I could feel the wheels of history literally turning.  You could feel it in the young people who turned out to support marriage equality. You could feel it in the older lesbian couples who flew in from Ohio just to be there.  You could feel in the gay dads schlepping their two young children to meet other families just like theirs!  Even when the opposition marched toward the several thousand gathered to support marriage equality-the opposition didn’t stay long.  The National Organization for Marriage and the Catholic Church bused in lots of Catholic high school students to march against marriage equality, many of whom were told they had to go or lose class credit! But the opposition marched toward us and was peaceably turned around by pro-marriage equality activists and the Capitol police. They marched back to their gathering place chanting, “One man, One Woman-only That’s what the Bible says!” I guess they haven’t read the story of Jacob, Leah, Rachel, Bilhah and Zilpah!

908758_10151519110782487_2128985697_nAs I took the podium to speak, I looked out on a sea of American flags and rainbow flags and people adorned in red it gave new meaning to the Red Sea! The crowd was so diverse, every race and ethnic group seemed present.  The signs people held aloft –included children of gay and lesbian parents who had homemade signs that proclaimed “Let my moms get married.”  One of my favorites was “Bigotry is not very Christian.”  Other couples had signs proclaiming how long they have been together 7 years-to 40 years to two older gentleman clearly in their 80’s who had been together nearly 60 years. It was very inspiring to be with Americans of every stripe who simply wanted their rights and responsibilities to care for their spouses.   I met a couple one in a wheelchair who had been the first to marry in the West Point Chapel.  Of course one was Jewish!

The scene outside as I spoke was different than the highly structured form and format of a Supreme Court hearing.  Even as some of the conservative justices wondered aloud if our country was ready for marriage equality, calling “it an experiment that hasn’t been around as long as the internet” it was clear from the number of years many of the couples has been together that gay “marriage” has been around forever. What hasn’t been around is the legal recognition and the protections embedded in the legal definition of marriage.

As I spoke about the Passover story and the themes of the holiday from degradation to dignity, from oppression to freedom the crowd understood that it was their story too.  Nine justices were deciding at the very moment and all were wondering if their hearts would be hardened to the arguments or whether finally LGBT couples who wish to marry will be able to do so.  In June we will find out how the Court will rule. So I am counting the days along with counting the omer.

Tuesday evening I had the privilege of co-leading a Prop 8 Passover Seder at the Equality Center at the Human Rights Campaign building. Formerly the B’nai Brith headquarters it was a poetic spatial affirmation between the Jewish commitment to tikkun olam that used to take place in those very rooms and the continuing work for equality and justice that is done now in the same space! The Passover Seder was organized by a former Religious Action Center Legislative Assistant, Joanna Blotner who now works for the Religious Coalition for Reproductive Rights.  Joanna grew up in our movement. She worked at HRC for several years after her time at the RAC. She is a straight ally. But she and a group of friends organized an amazing Seder with an inspiring Haggadah dedicated to equality for LGBT people and intertwined with the story of our Exodus from slavery!   More than 115 primarily young people in their 20’s and 30’s celebrated Passover together and talked about the meaning of equality, the meaning of liberty and the meaning of tikkun olam in the context of the Passover story.  I don’t know whether I was more moved by leading the Seder or being with these inspiring young leaders like Joanna!

There is no stopping now.  Whatever way the court rules (and pundits are having a field day trying to figure out from the questions how they will decide) the arc of justice is bending rapidly.  Just see the cover of the recent Time magazine. Watch the push for marriage equality in places like Minnesota, Rhode Island and Illinois.

And yet there are plenty of places where the LGBT community faced continued bigotry in the form of legislation. You can still be fired in 33 states in the United States for simply being gay. And in Arizona there is a terribly hateful “bathroom bill” aimed at transgender people.  And of course young people are still being bullied for perceived sexual orientation on school yards everywhere.

I have hope. This Passover gave me hope that we are on our way to the Promised Land. I have hope that the court will restore marriage equality in California. I have hope that DOMA will be declared unconstitutional. I have hope that the march to full equality is in full swing.  And I hope you all will actively work toward these freedoms in your community and work to actively help your young people learn how they can make a difference too.
